Dear All,
My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

I have an approved 140 and applied for 485 got by EAD and done my FP, however recently i got married and i want to know how do i add my wife to my current 485 status ??
My employer lawyer says ; 485 dates should be current to add my wife ?? is that true ??

Yes. I-134 is required. Make sure you send copies of all the pages in your passport (including blank ones).

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

Is it mandatory to spend [B]at least[B] 6 months residing in the US every calendar year after obtaining a GC? :confused:
If your stay is less than 1 year abroad, you can reenter using just your green card. If you want to stay 1-2 years outside the U.S, you will have to apply for a reentry permit before departure. But, it will be considered as a break (i.e, more than 1 year abroad) in the continous residence requirement of 5 years when it comes to your naturalization application.
If you want to stay longer than that, you will have to apply for "returning resident permit" for which you need to prove that your intent is to be a permanent resident but, your stay abroad longer than the period of the reentry permit was beyond your control.
Please consult an attorney so that you don't lose your PR.

It will be much easier to separate after GC is in hand. It's possible to get separated before and still get GC, but she would need to file additional paperwork. Consulting with an attorney is recommended.

I was more inclined towards 2nd option thinking that whether or not I get I94, if in case I have to use it, I can make a trip to India and get the stamping done?

i have a valid H1 visa on my passport till 14th dec 2007. yesterday i got the new I-797 with I-94(I-94 dates are mentioned as 15th Dec 2007 to 14th Dec 2010). Since my visa is expiring on 14th Dec 2007, I want to go for stamping before Dec 2007 to Nogales (i have some travel plans in Jan 2008). When can i go for(how soon) stamping. I am planning to go this sept. CAn I ?????

It was a nightmare for few weeks but, long story short...I got my new passport after the Embassy cannot find my original I sent for renewal. Please let me know if I need to get it stamped within any timeframe. My current I-797 expires MAY 2010. I have an approved 140 and EAD but my attourney suggested to stay on H1B.

You dont need a visa stamp on your new passport unless you want to use it to re-enter US when you travel. There is no time line associated with getting a visa stamp. You just need to make sure you keep extending your H1 status and get an I-94 with the extension approval. If you have an AP you can use it for re-entering and still can continue working on H1 for the same employer. Else, when you travel the next time, you can setup a visa appointment and get H1 stamped on your new passport.

You do NOT need to have an H4 visa stamped for change of status to H1, as long as you have a valid I-94. Don't worry.
