Does anyone know what email / letter(s) one should get when the GC is approved ?
I received this email two days ago:
On November 13, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours.
Does this constitute as a GC approval ?
I read in other threads that a "card ordered" email follows the GC approval but I haven't received the email (nor the physical card yet).
Does it normally take 1 or more weeks for the physical card to arrive after approval ?
Thank you for any insight you can provide.
hello Md_123,
Congratulations on crossing the greencard hurdle. You have been a member since March 2006 and have been participating in this struggle. You have also endured a long wait since Aug 2001. If you have not yet contributed pls do not forget to contribute some money to IV. It will help keep this struggle alive and help other members waiting in line.

I really like your 3rd and 4th stamps faster :) It's no bother at all. I add stamps every Wed/Fri, so it only takes me about 30 mins to get all of the stamps added up from everyone!

Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
The fees for most CIS applications are astronomical. For instance the fee for N-400 to become a US Citizen is $675/- The fee for adjusting status to become a permanent resident is $1010/- Many people simply cannot afford that. However previously there were no forms and no guidelines to filing anything without fees with the CIS. If anyone filed a form and could not afford a fee, they had to write a letter. But the mailroom personnel at CIS either does not read or perhaps cannot read. So the form used to be returned asking us to send the check. You could go back and forth and in the mean time loose time or even status.
Even more egregious were fees paid due to CIS' mistake. For instance if the CIS in clear cut error denied your case, you had to file a motion to reopen for $585/- We even had a case once where the CIS collected a fee for a I-765 (EAD) filing for $340/- and lost the file. When we traced and send them the check, the reply was that my bank should ask for the money back. My bank, Bank of America, did not know how to. So we simply paid again and refiled.
Now the CIS is proposing a form: I-912 which will establish clear guidelines for fee waivers. Hopefully the form in its approved version will have no fee requirements for CIS' mistakes along with applications for applicants below the poverty level.
Don't just start spending the money that you were saving for the CIS fees yet though. Sometimes these forms take years to come to fruition. As for me, I will believe it when I ultimately see it.

My wife is on H4 and she is studying Masters and we already have EAD. She would like to do Internship and she still has 6 months to graduation and my question is
1) Is there any time restrictions for people to do internship (with GC based EAD)
2) After graduation, can she still continue with her internship (using EAD ofcourse) ?
3) If Yes for question 2, then for how long after graduation she can be an intern
Apreciate if someone can give feedback on this.
Thanks in advance,
Prakash
AS PER MY KNOWLEDGE HERE ARE MY ANSWERS ....;)
1) She can do internship with EAD there is no porblem and no time restriction .
2) Yes she can continue ...
3) As long as she has a valid EAD ..

Visual Studio 2005 is the IDE - an application that allows you to create other applications. Silverlight is a target runtime much like WinForms, WPF, etc. You can use VS 2005 - albeit a bit hackishly - to create projects that allow you to create outputs for all three.
Based on your code, is this a ASP.net application?

If you are impacted by unavailability of visa number, you can get 3 year extension of H1B after I-140 is approved. If your priority date is current, then you have to file for status adjustment, not H1B extension. If your lawyer does not understand the law, better get a "real" lawyer :)
I just got my Labor approved a couple week ago and now i want to file I-140 premium processing. But my lawyer's not allow me to do that coz once my I-140 approve i can't file my 8 th year extension. My 7th years H1B will expire on Aug 30, 2007.
I'm very confused now, on my understanding once i get my I-140 approve, i'm eligible to get my H1B 3 years extension.
FYI: i chose CP opotion, is that make me not eligible to get my H1B extension once my I-140 approve?
Please help and Big thanks

Dear All:
Details: Indian, in H1-B status. Current visa stamp in passport expires in mid July but employer is applying for the extension.
The situation: I want to quit my job late this summer and relocating to Asia. Before I leave this continent, I'd like to travel around South America and maybe even do some volunteer work. I'd love to travel for at least 1 and maybe even 2 months.
Ideally, I would like to re-enter the US after this trip and collect my bags before flying to India.
What are my options for re-entering?
1) Get new H1-B stamp in passport before quitting the job (though this would be kind of a pain/expense). Quit the job, ask the company not to cancel the visa and re-enter the US after the trip on the new H1 stamp. I am guessing this is a somewhat risky option as I would technically be out of status, right?
2) How hard would it be to switch to a tourist visa and get a new stamp in a country like say Argentina or Mexico?
What do you think my best option is or am I out of luck?

This date is very important and you do not want to enter the wrong date.
I-94 dates are available on the I-797 reciept as well as if one enters the country via air. The latest I-94 that the applicant gets is the one that is valid.
For example, you applied for H1 and got an approved I-797 reciept. Then you went to India and got your visa stamped in your passport and you then came back to the US, and at the port of Entry you filled up a New I-94 form (white card). Then this white card takes precedence over your I-797 notice, since this was the last one obtained. Legally you are permitted to stay in the country till the expiry dateon this white I-94 card.
The later assume if you went in for your H1B extension and then recieved a new I-797 approval with a I-94 stub attached at the bottom (green I-94). Then since this green stub is the latest I-94 you have recieved , you are permitted to stay in the country legally till the expiry date on the green stub.
In case this is just your first I-94, and you haven't gone out of the country yet for any stamping of the visa on your passport, then the green stub I-94 on your I-797 is the one you ought to be referring to.
But once again, please consult your lawyer about this, as there can be various interpratations and you must understand all aspects of it.

Days come and go..
Months come and go..
Years come and go..
Visa bulletins come and go..
RFEs come and go..
Priority Dates come and go..
Bills come and go..
Senators come and go..
Presidents come and go..
Even, Recessions come and go (happened only a few time in the last century)..
BUT,,,,,,
Most of the immigrants come here but never go back.
Enjoy your stay here and live the fullest and stay focused with your job / career. Coz thats what keeps you going and I bet everyone here will get their green cards some day.
PS: I am a EB3 applicant waiting in the line for GC(hoping to get it in the next decade).

There is a specific time frame where, when and how the ad must be placed. In addition, there has to be multiple forms of recruitment efforts to hire USC. Also, if beneficiary(You) is involved or has known that such ad is being placed, then the whole process need to restart. There are other steps like state wage determination etc that should happen before an appliation for PERM can be filed. In short, you may not be able to use just a monster ad to file PERM application.

I am not sure if this discussion may be opened by someone already. I could'nt find it and hence I am opening a new one.
I know its not required to have SSN for starting the job from 10/01/2007. I am eager to know if we can apply for SSN before this date or do we need to wait until Oct 1st. Thanks

My dad's own brother is a U.S citizen. I am here on a H-1B
My dad wants to visit the U.S. Who would be better to sponsor him ?
Me or his brother ?
Also, if his brother sponsors him, would the consulate ask why are you not using your son's papers ?
Any help is appreciated.
Thanks
