Hi,
Can a H4 visa holder apply for the Praxis test series and then apply for State Teacher Certification. I know on H4 we can't work but is it possible , just getting the Teacher Certification.
I believe that you can take tests as long as you formally study on your own. But get this confirmed by a lawyer.
If it's not possible on H4 then I have an option to convert H4 to L2 (as my husband will change his status from H1 to L1) and get EAD.
Just a clarification: If your spouse changes from H1 to anything, your H-4 status is automatically terminated; there is no "option" to retain it.
Can after that can I get the Teacher Certification from PA ?
I checked on PA State Teacher Certification requirement for Foreign Educated Teachers and there is one point like this.

I need advice on my situation. My wife filed EB2 based 485 application through her employer and my application and my son's application were filed as derivative applications. My priority date is Dec 2005 and country of chargeability is India. My application and my son's application were approved on August 04, 2010 but my wife's application is still pending approval. It has been nearly 10 days since derivative applications were approved.
I understand that derivative applications cannot be approved without primary application getting approved first but why, then, my wife's application is still showing "initial review"?
I am confused and getting a little worried about this. Any advice will be appreciated.

Thank you so much. I am much relieved now. So, As long as I work for the sponsoring employer(even though the labor location is different) is it ok to file Ac-21 and move to another employer.? My impression was that I was obliged to work for that exact position(the one on the labor) to prove the 'intent'.

So the heat is now on employers to clean the house, it is also a great burden on employees to find work. As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

Hi All,
What is the priority date?There is an employer who filled PERM for me in October 2008 and the PERM was approved.I-140 was not filled.
The employer laid me off due to bad economy. Can I still claim October 2008 as my priority date?

When we use the recent I94 (from the H1), do we need to say "were you inspected by an immigration officer?" as "yes"?
The start date for this should be the date of entry at the airport or the start date on the recent I94?
You were inspected by the immigration officer thats how you got the I94, there is no I-94 vending machines out there, atleast that I know of.
Your second question is not clear. Ur Date of Entry is ur start date of the I-94, so whats the question.

Better not, US does exactly the opposite to what someone asks her :D
I think India must ask US to send back all the skilled H1b holders exactly after 6 years and not issue GC. Then you would be surprised to see heck of a lot approvals !!!!

If yes, on whose name should we register the company ? Should I register on my name or is it anyway safer to register on my wifes name?

Company A has not cancelled my H1 and I am in good terms with them.

If your lawyer or you can get through to a person at BEC maybe you could get that person would agree to accept mail addressed to a specific person at the BEC, that way there would be someone to contact to check that they have it.
Obviously they wouldn't normally do that, but if someone there believes the lawyer that it was lost twice then they might take pitty.
That way you are dealing with someone rather than a black box.
