Pls sincerely advice if he can still apply for H1B in April 2008, if he just missed 365 days out of country rule by 6 or 7 days (incase he comes back on Aug 10th 2007 for filing, he would fulfill 360 days out of country and not 365 as needed) ?
please do some research on immigrationportal.com. i recall reading that short visits should not reset the H1B 365 day clock. days of short visits will just not get counted towards the 365 days.

Your status does not change to H1B till October 1st, 2009 so by default you are on OPT till that time. Now, you might want to check with your company lawyers if they are going ahead with the filing. My feeling is , they are going to go ahead with the filing since only after an H1B is laid off, USCIS is notified by the sponsoring employer. If you don't file on the April time frame, you might miss the bus for this year and your next shot comes only in April 2010. Take a moment off and think with a cool head, what do you think would be good for you and your career.

databases for CSC and NSC are aligned and then notices are sent automatically. Unless that happens one has to wait to get the FP notice.

Our appointment was at 9:00 Am but due to NJ traffic we reached at 10:00 AM. We both were worried that we may be turned back but it turnout that they had given 9:00 AM appointment to everyone.
As soon as you will go on the second floor you will be handed over a cardboard with an application to be filled by you. Fill that application and wait in a line to be called by a clerk for checking your ID and hands. The person will closely check your hand, most probably to make sure that they are good for FP.
Once she is satisfied, you will be given a number and asked to be seated in a big hall. Your number will be called and the person will take FP for every fingers in your hand. You will also be photographed.
The whole process took us an hour.
Just one more thing, plenty of parking is available in front of the prudential building.

if u go to the doc, they will perform the the tests that are ok to perform..
Check with doc if they will accept the test results (PAP , HIV , etc) from your obgyns office. These tests are already done during initial stages of pregnancy.
Finally the doc will add a note to the medical report that some tests/shots are omited due to pregnancy.

Will the case be accepted with this partial report-- It will be.
Will there be an RFE? -- i dont know.. may be

How do I go about doing that when I can't even set foot on Canada? I am predicting I will get my canadian visa by end of August (usually takes 2 weeks for me to get).
Secondly how do you explain this:
going forward, the MRV fee will have to be paid prior to scheduling appointment. But then to pay the MRV fee I have to be in Canada. But then to be in Canada, the canadian consulate need the appointment letter. It's a catch 22 .

My friends recently went to the consulte in Nogales to get their H1B stamped and they told me that we can enter Nogales with out any visa ... You might want to explore that or find any other places that are closer to where u live and do not need a visa to get a new I94 ...

Hello friends,
My prority will be current in Aug, next month. I filed I485 last july and my I140 is also approved long back in 2006. After filing I485 i do not see any LUD or anything on my case.
What will be the chances to get my I485 approve ? Do i need to followup / take appointment ( Infopass) etc ?

I quit this company has he hasn't paid any bench salary and haven't do any proper marketing - which were force me choose a permanent job.
So could some one please advise me the right lawyer to handle this.I need to answer to this summons and need file a new case against them.
Points that summons contain :
FIRST COUNT : Breach of Contract
Second Count : Tortious Interference
Third Count : Breach of Duty of Good Faith and Fair Dealing
Fourth Count : Unjust Enrichment
Fifth Count :Misrepresentation and Fraud
SIXTH count : Breach of Duty of Loyalty

I am planning to apply my niece to come to USA to study 8th grader in private school. She is 13 years old in May 2011. I believe she doesn't need to go for an interview at US embassy in Bangkok Thailand. What do I suppose to do then? How do I submit her DS-160 (already finish filling online) and other document? if your employer ( who filled I 140 ) revoke I 140 then chances are there that you may get RFE while H1b transfer. You need good lawer advise. Also there is gray area for porting PD if I 140 is approved and revoked.
My current employer (who's the consulting company) is the one negotiating to let me go fulltime with the client. So, they shouldn't revoke the 140.

FYI: Ours went to R Williams on July 2nd/NSC and there is thread on this forum if you are interested. We heard nothing. According to the posts, if any of R Williams cases had any action, they happened at other service centers. You person might be sending the submittals around as well if they were received on July 2nd. 1. I would like to believe that all visa numbers include the dependents etc .. since USCIS has the numbers.
2. At the same time .. maybe 245i is kicking in .. else the priority dates would be different

Is 245i only affecting eb3 and not eb2?
And also from the answers it looks like, inspite of uscis making the numbers public .. it doesn't help us make a prediction
