Dear Immigration lawyer and fellow Ivians,
I received GC with my wife and one minor son. Other minor son's status did not change. Today I am seeing following hard LUD on my son's I-485.
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case has been sent for a standard interview.
On August 21, 2008, we transferred this case to our NATIONAL BENEFITS CENTER location to conduct the interview that is a standard part of processing this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. You will be sent a notice when the interview is scheduled, or if the office needs something from you. If you move while this case is pending, call customer service.
Do I need to worry? Normally for employment based adjustment of status, interview is not required. Could this be USCIS error? Do I need to do anything?

Dear Fellas,
I went for H1b Stamping a couple of months back. I was given a 221 g at that time and later on was asked for company's tax documents. During this time I did not hear any thing from US embassy in islamabad and got the same reply that my case was under administrative processing.
yesterday I received a letter from US embassy saying that my petition was returned to INS. The whole process has been very frustrating and I even left a couple of good offers hoping that H1b will get through anyways I guess its over for me now......
Did any one else face the same situation?? Will it do any good to reapply?

Sorry to hear about it. Don't get discouraged though, you will find new offers soon, just keep trying. Remember that persistence creates luck. About the reapplying for visa, I guess you should first talk to your company about it and then with the lawyers who helped prepare the documents. I guess, that'd be good place to start with. In the mean time, keep an eye on the opportunities in your home country. Good luck.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?

My PD is not in this range. Mine is July-2001 kind of >= 2002.
I have seen an ALIA observation on EB2 Retro. Trying to figureout how soon these Visa #'s for EB2 catagory is vanished. I will have an analysis from this will post here.

Where does that put us considering the house bill didn't even make it to markup today?
I thought it was E-verify and our bill with some sunset bills. Now he excluded those things and added last item which Republicans never supports. So he is making this as suicide bill . This is all about politics. See how they turned back in last minutes. Now they created a image of Immi friendly but eventually they didn't fight for us. Bob was Anti in beginning and he introduce recapture so get our support now after becoming popular among us and our friends , relatives he is officially not stopping bill but killing it.

Nebraska Service Center mailed I-131 approval notices for me and my wife on 28th Oct. But we never received them. Its been a month now. So, I called USCIS today morning and they say I need to reapply for I-131 for my whole family because some one else might have picked it up.
I called up post office. They say they have no mails on hold.
Is reapplying the only way out?
This happened with me with Texas service center. They insisted they had sent it. But in reality they never sent it. I was told the same "You need to apply for a fresh one. That is the only way out of it." I was determined not to pay fees a second time for no fault of mine.
Details below. (Not sure about NSC though)

Here is my understanding --
If the sister company uses a different Fed Tax ID (i.e. is an independent company legally), they can file your GC in EB2 using your experience in previous company.
I did not face this situation but somewhat similar. Our company was acquired by another holding company but we are maintaining our Tax ID. The Attorney said that my H1 as well as GC process remains valid since we are being treated as a independent company legally.

Hello guys,
I came to US to pursue masters, and have started working on H1b while working on my thesis in parallel. Meanwhile my advisor did not get his tenure approved, and had to leave the university. So I had to abandon my thesis work, and had to register for extra courses. My employer and the client I work for are okay to let me go to university for 2 months, but my employer did not pay me for the period (no paystubs for this period). So my year-end wages fell short of the LCA amount.
I know that unpaid leave is not legal while on bench, but since I took the leave while I was actually on a project, does anybody think mine is a genuine case, if there is any such thing??
I am looking to go for stamping, and is really urgent

I understand that the priority date remains the same. In our case the priority date is Feb 05. I wanted to know what will be the process going forward. Currently the EB3-EB2 application is on the PERM labor state. Once that gets approved does it mean that our I485 will be adjudicated immediately since for EB2 the priority date has already gone past ours (feb 05)? Or we will need to then apply for another I-140?
If anyone knows the process of EB3 to EB2 transfer can he/she kindly post it?
